1.1 Personal Information
We may collect personal information that you provide to us, such as your name, email address, and other contact details when you create an account or communicate with us.
1.2 Usage Data
We may collect certain information automatically when you use the Lyvia App, such as your IP address, device information, operating system, and usage statistics. This information helps us understand how the App is used and improve its functionality.
1.3 Purchase and Service-Usage Evidence
When you purchase credits or a subscription, we retain a restricted billing record that may include your account identifier, email, purchase details, billing address supplied to Stripe, acceptance of purchase terms, IP address, device or browser information, and timestamps. When you submit a generation, we also retain a restricted usage record that may include the prompt and negative prompt you submitted, selected model, credits consumed, job and output identifiers, IP address, device or browser information, status, and timestamps.
We use these records to provide support, prevent fraud and abuse, establish that digital services were delivered, and respond to payment disputes or legal claims. They are not publicly visible and are available only to authorized personnel and service providers with a need to process the payment or dispute.
2. Use of Information
We may use the collected information for the following purposes:
- To provide and maintain the Lyvia App and its features.
- To communicate with you regarding updates, changes, or promotions related to the App.
- To protect our legal rights and prevent misuse or unauthorized access to the App.
3. Sharing of Information
We may share your personal information in the following circumstances:
- With our trusted service providers who assist us in delivering and maintaining the Lyvia App.
- In response to a valid legal request or to comply with applicable laws, regulations, or court orders.
- If we believe disclosure is necessary to protect our rights, safety, or the rights and safety of others.
3.1 Optional Marketing Emails
If you choose to receive Lyvia marketing emails, we share your email address, display name, Lyvia account identifier, subscription tier, signup date, and email preference with Sequenzy, our email marketing service provider. Sequenzy processes this information on our behalf to manage subscribers, deliver campaigns, and measure email delivery and engagement. Marketing email consent is optional and is not required to use Lyvia.
You can withdraw consent at any time from Account Settings or by using the unsubscribe link in an email. Unsubscribing stops marketing campaigns and automated marketing sequences. We synchronize that choice back to your Lyvia account and retain the minimum suppression information needed to respect it. Transactional or service-related messages may still be sent when necessary to operate your account.
4. Data Security
We take reasonable measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, please note that no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
Purchase and service-usage evidence is generally retained for up to 24 months. We may retain records longer where reasonably necessary for an active payment dispute, fraud investigation, legal claim, or legal obligation.
5. Face Data and Uploaded Media
The Lyvia App may temporarily store face data and uploaded media, only for the purpose of creating AI-generated images and videos on your request. Uploaded media will be deleted after generation is complete or the app is closed. We do not store or share this data. By using the App, you agree to the processing of your face data and uploaded media for this purpose.
6. Children's Privacy
The Lyvia App is not intended for use by individuals under the age of 13. We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected personal information from a child, we will promptly delete it.
7. Changes to the Privacy Policy
We reserve the right to update or modify this Privacy Policy at any time. We will notify you of any material changes by posting the updated Privacy Policy within the Lyvia App. Your continued use of the App after the modifications will signify your acceptance of the revised Privacy Policy.
